1. Account Registration

To access certain features, including subscriptions, you may be required to create an account.
You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Notify us immediately of unauthorized use

You are responsible for all activity under your account.

2. Subscriptions

Subscription Plans

We offer subscription-based access to certain features or content. Details of available plans, pricing, and billing intervals are displayed on the website.

Billing and Payment

• Subscriptions are billed in advance on a annual basis.
• Prices may change with prior notice as required by law.

Automatic Renewal

• Unless canceled before the end of the current billing period, your subscriptions purchased via credit card will automatically renew for the same duration and at the then-current price.
• Subscriptions purchased via bank transfer are not subject to automatic renewal.

3. Subscription Use Rights

Personal Subscriptions (Personal Use)

Standard subscriptions are intended for personal, non-commercial use only.

Access is limited to the registered account holder. As a limited exception, the account holder may permit use by members of their immediate family within the same household, provided such use is for personal purposes only and does not circumvent any technical or usage limits of the Service.

Sharing, transferring, sublicensing, or making the subscription available to any third party outside this permitted family use is not allowed.

Professional Subscriptions (Commercial and Personal Use) - Available for Designer Service

A Professional subscription grants the account holder the right to use the Service for commercial and professional purposes, including use in the course of business, self-employment, or professional activities.

Unless expressly stated otherwise in the Pro plan description:

• Access is limited to the registered account holder or a single legal entity
• The subscription may not be shared with multiple users, teams, or clients

If additional users, seats, or team access are required, a separate plan or written agreement must be obtained.

Using the Course Designer for business purposes requires a Professional subscription.

Definitions

"Commercial use" means use of the Service primarily intended for, or reasonably connected with, revenue-generating, professional, business, or organizational activities.

"Immediate family" means a spouse or partner and dependent children living in the same household as the account holder.

4. Free Trials

All personal tools (that is, Designer, Journal and Trials) can be tested for free during 1 month, without functional limitation and without the need to provide payment (credit card) details.

Only one free trial per user unless stated otherwise.

The free trial can be activated on the subscriptions page.

5. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Refunds

As the Designer, Journal and Trials Services can be tested for free during 1 month, no refunds or credits are provided.

6. Use of the Service

You agree not to:

• Use the Service for unlawful purposes
• Interfere with the operation or security of the Service
• Reverse engineer or attempt to extract source code

6. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or applicable law.

Upon termination, your right to use the Service will immediately cease.

7. Intellectual Property

The Site and its original content, features and functionality are owned by Smarter Agility and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.

Further, Smarter Agility does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business
• Errors, interruptions, or service downtime
• Our total liability shall not exceed the amount paid by you for the subscription during the last 12 months.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the Service or violation of these Terms.

11. Revisions and Errata

The materials appearing on Smarter Agility's web site could include technical, typographical, or photographic errors. Smarter Agility does not warrant that any of the materials on its web site are accurate, complete, or current. Smarter Agility may make changes to the materials contained on its web site at any time without notice. Smarter Agility does not, however, make any commitment to update the materials.

12. Links

We has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by us of that link. Use of any such linked web site is at the user's own risk.

13. Changes to the Terms

We may update these Terms from time to time. Changes will be effective upon posting on the Website. Continued use of the Service constitutes acceptance of the updated Terms.

14. Governing Law

Any claim relating to our Services shall be governed by the laws of the State of Belgium without regard to its conflict of law provisions.
